Processing of Personal Data

The processing of personal data is carried out in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”).
What Data We Collect
Apart from tracking tools or cookies described in the Website’s Cookie Policy—regarding which you may have provided consent or refusal through the banner displayed upon accessing the Website—we collect exclusively the following personal data: first name and last name, email address, city and residential address, mobile phone number.
These data are voluntarily provided by users in the following circumstances:
a) when subscribing to YAG Garage promotional and informational communications;
b) through online advertising campaigns (META subscription forms);
c) outside the Website, by completing and signing paper forms available at the exhibition venue.
Purpose of Data Processing
The personal data collected through the Website or in person in paper form as described above (email address, city and residential address, first name and last name, and mobile phone number) are processed exclusively for informational and promotional purposes related to YAG Garage activities, such as sending newsletters, SMS communications, or other equivalent electronic or paper communications containing updates on exhibitions, events, artists, and cultural initiatives.
The legal basis for processing is the explicit consent provided by the data subject pursuant to Article 6(1)(a) of Regulation (EU) 2016/679.
Failure to provide consent will prevent us from processing your data for the described purposes and therefore from providing the above-mentioned services. Consent may be withdrawn at any time.
Third-Party Recipients of Data
If you wish to receive updates regarding YAG Garage activities, events, exhibitions, and initiatives, the personal data provided (such as first name, last name, residential address, and email address) will be processed for sending informational and promotional communications, including through automated tools.

Methods of Processing and Security Measures
Your data will be processed in accordance with the principles of fairness, lawfulness, and transparency, both manually and with the aid of electronic tools, following the adoption of appropriate security measures to prevent unauthorized access, theft, accidental loss, or unauthorized processing.
In the unlikely event that the Foundation believes that the security of your personal data in its possession or under its control has been or may have been compromised, you will be informed in accordance with applicable laws and through the prescribed methods (by providing your email address, you consent to receiving such communications electronically). The Foundation will also inform the Italian Data Protection Authority.
Scope of Communication and Disclosure of Data
Personal data will not be disclosed, unless required by law or expressly authorized.
They may only be communicated to:
− persons authorized by the Data Controller to process data for the above-mentioned purposes. To this end, Etipublica ensures that its internal staff is properly trained regarding the importance of personal data protection and adopts appropriate security measures;
− entities acting as independent Data Controllers, where required by law;
− external Data Processors, namely entities contractually authorized to operate in the name and on behalf of Etipublica under a service agreement and appointment pursuant to Article 28 GDPR.
Such companies, entities, and organizations will receive only the personal data strictly necessary to perform the agreed services or to comply with legal obligations and will not be authorized to use them for any other purpose.
The Foundation intends to actively cooperate with law enforcement authorities to prevent and suppress any form of abuse or unlawful and/or fraudulent use of its services.
Social Media
The Website may include plug-ins or sharing buttons that allow users to share YAG Garage content on social media platforms (such as Facebook, X/Twitter, LinkedIn).
Please note that when you choose to use these tools, the collection and further processing of data are carried out directly by the social media platforms in accordance with their respective privacy policies, which we encourage you to review carefully.
Fondazione Etipublica does not collect or control any personal data acquired by social media through such plug-ins. No information is automatically shared from the Website to social media platforms, and users cannot access or interact with the YAG Garage Website through their social media accounts.
Protection of Minors’ Privacy
The Website is intended for a general audience; however, the services offered, including newsletter subscriptions and the receipt of informational messages, are intended exclusively for individuals aged 18 or older.
Fondazione Etipublica does not knowingly collect, use, or disclose personal data provided by individuals under 18 years of age.
If you do not meet the required age, please do not provide your personal data and ask a parent or legal guardian to proceed with any subscription.
Data Retention
The collected data (email address, city and residential address, first name and last name, and mobile phone number) are retained until consent is withdrawn and in any case for a maximum period of 60 months (5 years) from the last documented interaction, in order to allow users to remain informed even years after their last participation in cultural events, in compliance with the principles of relevance, proportionality, and data minimization set out in the GDPR.
The retention period is justified by the nature of the activities carried out. The organization promotes artistic events that are distinct and often unique rather than serial, but part of a broader cultural program developed over a multi-year period, typically lasting five years.
In this context, subscribers’ interest is not limited to a single event but extends to the overall artistic activity of the organization, whose periodicity is not regular or predictable.
An annual review of the necessity of data retention is carried out, with deletion or anonymization of data no longer relevant.
Data may be retained beyond the above period only in cases provided for by law, in order to comply with legal obligations, protect the Foundation’s rights, resolve disputes, or prevent abuse, provided that before the expiry of the retention period an out-of-court or judicial dispute has arisen requiring continued processing for the duration necessary to resolve it. In any case, data will not be retained longer than strictly necessary for such residual purposes.
The data are stored in data centers located in Italy or within the European Union and will not be transferred outside the European Union.
